PERSONAL DATA PROCESSING POLICY
Under and by effect of Article 13 of the European Regulation 2016/679 concerning the protection of natural persons with regard to the processing of personal data (General Data Protection Regulation – GDPR).
As required by the General Data Protection Regulation of the European Union (GDPR 2016/679, Article 13), before proceeding with processing, the data subject (User of the website marwear.it) is informed that the personal data collected through the website are subject to processing by Marwear™ using computer and/or electronic tools, for the purposes indicated in this policy.
For this purpose, the User is presented with the Privacy Policy prepared by Marwear™ (hereinafter the “Data Controller”), creator and promoter of the activities available on the website marwear.it.
DATA CONTROLLER
The Data Controller of personal data is Marwear™, with its registered office at Via Kramer, 21 20129, Milan, Italy; VAT Number: 13063960960.
The Company has appointed a Data Protection Officer, under and by effect of Article 37 and the European Regulation 2016/679, as Chiara Bergonti.

PROCESSING INFORMATION
The personal data subject to processing are collected directly by Marwear™ or by third parties expressly authorized by the Data Controller, or communicated by the Company to such third parties for the pursuit of the purposes described below.
LEGAL BASIS AND PURPOSES OF PROCESSING
The personal data provided by the User during navigation on the website marwear.it are processed by the Data Controller in accordance with the current legislation for the protection of personal data.
The legal basis for processing is identified in the provision of its services by Marwear™, in the management and facilitation of the website, as well as in the stipulation, execution, and possible termination of the online sales contract concluded between the parties, and in the obligations of the same contract directly and/or indirectly arising from it.
The processing of personal data by Marwear™ is aimed at the following purposes:
- PHYSICAL PERSON PROFILING: Only after your express and explicit consent, the personal data you have provided may be processed by the Data Controller for profiling activities, or analysis of your preferences aimed at creating personalized content and offers.
NATURE OF PROCESSING
Regarding the purposes mentioned in point 1) of the previous section, the provision of your personal data and consent to its processing are optional.
Failure to grant consent will make it impossible for Marwear™ to perform profiling activities, or analyze your preferences for the creation of personalized content and offers.
Personal Data Processing – The Data Controller manages the personal data provided by the User during navigation on the marwear.it website, during any registrations/subscriptions to services/programs made available by Marwear™ and/or the possible purchase of goods offered by Marwear™. Examples of personal data include name, surname, and email address, in addition to the data necessary for the conclusion of the online sale contract, such as data functional to the execution of payment, shipping, and the exchange of goods purchased.
Methods of Data Processing and Storage – The processing of personal data is carried out by the Data Controller in accordance with the provisions of current Privacy legislation. The Data Controller processes personal data using computer and/or electronic tools and with organizational and logical procedures strictly related to the purposes indicated in this policy, also adopting appropriate security measures to prevent unauthorized access, disclosure, unauthorized modification or destruction of personal data, their loss and their illegal and improper use. However, Marwear™ cannot guarantee to its Users that the measures adopted for the security of the website and the transmission of data and information on the website are capable of limiting or excluding any risk of unauthorized access or loss of data by devices belonging to the User. For this reason, it is suggested that website Users ensure that their computer is equipped with adequate software for the protection of data transmission (such as updated antivirus) and that their Internet provider has adopted adequate measures for the security of data transmission over the network. Marwear™ also commits to processing data according to the principles of fairness, legality, and transparency, to collecting data to the necessary and accurate extent for processing, and to allowing its use only by personnel for authorized purposes. The management and storage of personal data acquired will take place in archives or on servers located within the European Union owned by the Data Controller and/or by third-party companies designated as External Data Processors and, in any case, currently located in Italy.
Regarding the different purposes for which data are collected, personal data will be stored for the time strictly necessary to achieve such purpose and, in any case, in compliance with the relevant prevailing regulations.
Data Controllers and Recipients of Data Processing – The collected data will not be disseminated in any way but will be processed within the limits and for the purposes described by the employees of Marwear™ based on adequate operational instructions (for example, administrative, commercial, marketing, legal staff, system administrators, etc.). Some data processing may also be performed by third parties, appointed as External Data Processors, on whom the Data Controller relies or may use in the management of the contractual relationship, in the provision of services offered, and in the organizational needs of its activities. Specifically, the data may be communicated to:
a) Individuals, public and private, who can access the data by virtue of legal provision, regulation, or community legislation, within the limits set by these rules;
b) Individuals who need access to the data for purposes related to the existing contractual relationship between the parties, strictly necessary for the performance of ancillary tasks (such as banks and financiers, technical service providers, hosting providers, IT companies, communication agencies, couriers, and shipping companies);
c) Consultants, to the extent necessary for the performance of their professional functions.
The updated list of External Data Processors and other authorized persons processing the data is kept at the registered office of the Data Controller and is available to the interested party upon request sent via email to support@marwear.it.
Data Transfer Abroad – The management and storage of personal data will be conducted on servers owned by the Data Controller and/or third-party companies duly appointed as External Data Processors located within the European Union.
Your personal data may be transferred abroad, in accordance with current legislation, even to countries outside the European Union.
The transfer to countries outside the EU, besides the cases where this is guaranteed by Adequacy Decisions of the Commission, is carried out in a way to provide adequate and appropriate guarantees under Articles 46, 47, or 49 of the Regulation.
Rights of the Data Subject – As a data subject, you can exercise, at any time, the rights granted to you by Articles 15, 16, 17, 18, 20, and 21 of the GDPR, which specifically provide the rights to:
a) Obtain from the Data Controller, under Article 15, confirmation as to whether or not personal data concerning you are being processed, and if so, to access the data and information such as: (i) the purposes of the processing; (ii) the categories of personal data concerned; (iii) the recipients or categories of recipients to whom the personal data have been or will be disclosed, particularly recipients in Third Countries or at International Organizations; (iv) where possible, the envisaged period for which the personal data will be stored, or if not possible, the criteria used to determine that period;
b) Obtain from the Data Controller, under Article 16, the correction of inaccurate personal data concerning you without undue delay. Considering the purposes of the processing, you have the right to have incomplete personal data completed, by providing a supplementary statement;
c) Obtain from the Data Controller, under Article 17, the deletion of your personal data without undue delay. The Controller is obliged to erase personal data without undue delay under certain conditions outlined in paragraph 1 of Article 17;
d) Obtain from the Data Controller, under Article 18, restriction of processing where one of the scenarios specified in paragraph 1 of Article 18 applies;
e) Obtain from the Data Controller, under Article 20, the portability of data, i.e., to receive your personal data, which you have provided to a controller, in a structured, commonly used, and machine-readable format. You also have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, under the conditions laid out in paragraph 1 of Article 20. Moreover, you have the right to have the personal data transmitted directly from one controller to another, where technically feasible;
f) Object, in whole or in part, under Article 21, to the processing of your personal data.

Please note that you have the right to withdraw your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal, without prejudice to the consequences mentioned above regarding the refusal to provide such personal data. You also have the right to lodge a complaint with a supervisory authority.

Marwear™ will respond to requests from the data subject within one month, except in cases of particular complexity, for which up to a maximum of three months may be required. In any case, the Data Controller will provide the data subject with the reason for the delayed response within one month of the request. The outcome of the request will be provided in writing or in electronic format. In the event of a request for rectification, deletion, and restriction of processing, the Data Controller will communicate the results of the requests received from the data subject to each of the recipients of their data, unless this proves impossible or involves a disproportionate effort.
Marwear™ specifies that a fee may be charged to the Data Subject if the requests are found to be unfounded, excessive, or repetitive; in this regard, the Data Controller will maintain a register to track the requests for intervention.
Changes to this Policy – The Data Controller reserves the right to make changes to this Privacy Policy at any time by notifying users on the marwear.it website. Therefore, please frequently consult this page, referring to the date of the last modification indicated at the bottom of the policy. If the changes made to this Privacy Policy are not accepted, the Data Subject may request the Data Controller to delete their personal data. Unless otherwise specified, the previous Privacy Policy will continue to apply to personal data collected up to that point.
